What Exactly is HRD Corp?
So, HRD Corp, which used to be called HRDF, is basically a government agency set up here in Malaysia. Think of it as a special "fund" that helps Malaysian companies and their employees improve their skills and learn new things.
How Does HRD Corp Work? This "fund" gets its money mainly from a "training levy" (or human resources tax) that eligible companies pay every month. Once these companies pay into the fund, they can then apply for grants from HRD Corp to claim back the costs of eligible training courses their employees attend. So, if you pay in, you can claim back!
What's Its Main Goal? HRD Corp's main goal is to make sure Malaysia's workforce keeps learning and developing to keep up with the changing economy and new technologies. By funding training, HRD Corp aims to make employees more productive, more skilled, and more employable, which helps the country's economy grow and stay competitive. In short, it's a platform that provides financial support to employers to encourage employee training and skill upgrades.
Which Companies Need to Pay HRD Corp Levy?
Not all companies have to pay this "training levy," it mainly depends on two key things:
How many employees does your company have?
Employers with 10 or more employees: It's mandatory to register and pay the training levy.
Employers with 5 to 9 employees: You have the option to register. However, once you choose to register, you must follow all the rules, including paying the levy regularly.
What industry is your company in?
The HRD Corp Act covers almost all major economic sectors in Malaysia, including manufacturing, mining and quarrying, and various service industries (like tourism, hospitality, banking, insurance, telecommunications, utilities, education, healthcare, wholesale and retail trade, security services, professional services, and all other services, but excluding the public sector).
But if your company's business isn't covered by their listed industries, then you don't need to register and pay. Just keep in mind that HRD Corp's scope can expand over time, so employers should always check for the latest updates.
How Much Do You Need to Pay?
For mandatory registered employers (10 or more employees): 1% of your total monthly payroll.
For optional registered employers (5 to 9 employees): 0.5% of your total monthly payroll.
What Happens If You Don't Pay?
If your company doesn't follow the HRD Corp Act rules, like not registering on time or not paying the training levy, you could face these penalties:
Fines:
Under Section 13(2) of the HRD Act 1965, any employer who fails to register within the specified time can be fined up to RM10,000, or imprisoned for up to one year, or both, if found guilty.
For employers who fail to pay the training levy on time, in addition to having to pay the overdue amount, there's usually a 10% penalty on the outstanding amount.
Loss of Training Grant Eligibility:
Employers who don't register or pay on time will not be able to apply for any training grants offered by HRD Corp. This means your company won't get reimbursed for employee training costs, which can significantly impact your training budget and employee development opportunities.
Legal Action:
HRD Corp has the right to take legal action against employers who consistently fail to comply, using the courts to enforce registration and payment obligations.

Types of HRD Corp Training Grants (Quick Look!)

SBL-Khas (Skim Bantuan Latihan Khas): This is the main grant. It gives money to companies to send employees for external training courses. It's very broad, covering all kinds of skill upgrades and professional development.
ALAT (Allowance for Local Training): This grant usually provides an allowance to help employers cover costs for employees attending specific training courses within Malaysia.
IT (Industrial Training): This is specifically for companies to fund the costs of industrial training for apprentices or interns.

你的公司是做什么行业的?
HRD Corp 的规定几乎涵盖了马来西亚所有主要行业,比如制造业、采矿业、各种服务业(旅游、酒店、银行、保险、电信、公用事业、教育、医疗、批发零售、保安服务等等)。
但如果你的公司做的业务不在它规定的范围里,那就不需要注册交钱。不过呢,HRD Corp 的范围会不时扩大,所以老板们要多留意最新消息哦。
要交多少钱呢?
强制注册的公司(10个员工或以上):每个月员工总薪水的 1%。
自愿注册的公司(5到9个员工):每个月员工总薪水的 0.5%。
不交钱会有什么后果?
如果你公司不按规定注册或不按时交钱给 HRD Corp,那可就麻烦了,会有这些惩罚:
罚款:
根据《1965年人力资源发展法案》第13(2)条,任何没在规定时间里注册的公司,一旦被抓到,最高可能要罚 RM10,000,或者坐牢不超过一年,或者两个都来。
如果你没按时交税,除了要把欠的钱补上,通常还会被罚欠款的 10%。
拿不到培训拨款:
你肯定就不能申请 HRD Corp 的任何培训拨款了。这意味着你公司送员工去培训的钱,HRD Corp 就不会给你报销,这对培训预算和员工成长影响很大。
可能被起诉:
HRD Corp 有权把那些一直不遵守规定的公司告上法庭,强制他们去注册和交钱。
